ACLU Comment on Trump Administration’s Attempt to Repackage Failed Immigration Detainer Policies

NEW YORK — Thomas Homan, acting director of U.S. Immigration and Customs Enforcement (ICE), and representatives of the National Sheriffs’ Association and Major County Sheriffs of America today announced a plan under which 17  local jails in Florida will keep people in custody for ICE after they should be released, on ICE’s request and without judicial warrant or approval.

Omar Jadwat, director of the American Civil Liberties Union’s Immigrants’ Rights Project, had this reaction:

“This plan is simply a repackaging of failed detainer policies that leaves sheriffs and jails on the hook for civil rights violations. Nothing announced today addresses the basic legal problems with detainers that courts have repeatedly recognized, and this is yet another example of the Trump administration running roughshod over the law in pursuit of its mass deportation agenda.”
